樞機組成特殊團體,有權依特別法選舉教宗;樞機得以團體性行動協助教宗,即為處理比較重要的問題而被召集時;或個別協助教宗,即由於所盡各種職務,幫助教宗管理普世教會的日常事務。

Can. 349

The Cardinals of the Holy Roman Church constitute a special College, whose prerogative it is to elect the Roman Pontiff in accordance with the norms of a special law. The Cardinals are also available to the Roman Pontiff, either acting collegially, when they are summoned together to deal with questions of major importance, or acting individually, that is, in the offices which they hold in assisting the Roman Pontiff especially in the daily care of the universal Church.

1 項-擢陞樞機者是由教宗自由揀選的男士,至少已領司鐸聖職,其學識與道德以及作事的才智皆超群出眾,未陞主教者應接受主教祝聖禮。

2 項-樞機由教宗之諭令而產生,在樞機團面前公佈,公佈後,即享法定的義務及權利。

3 項-擢陞的樞機雖經教宗宣佈,但其名「默存心中」者,此時無樞機的任何義務,也不享有任何權利,但當其名為教宗公佈後,即應遵守義務,並享有權利,但其所享的席次權,始自「默存於心」時。

Can. 351

1. Those to be promoted Cardinals are men freely selected by the Roman Pontiff, who are at least in the order of the priesthood and are truly outstanding for doctrine, virtue, piety and prudence in practical matters; those who are not already Bishops must receive episcopal consecration.

2. Cardinals are created by a decree of the Roman Pontiff, which in fact is published in the presence of the College of Cardinals. From the moment of publication, they are bound by the obligations and they enjoy these rights defined in the law.

3. A person promoted to the dignity of Cardinal, whose creation the Roman Pontiff announces, but whose name he reserves in pectore, is not at that time bound by the obligations nor does he enjoy the rights of a Cardinal. When his name is published by the Roman Pontiff, however, he is bound by these obligations and enjoys these rights, but his right of precedence dates from the day of the reservation in pectore.
